Credit cards are subject to verification and authorization by the issuing bank. If the bank does not authorize the payment, Paws&Pours will not be liable for any delay or failure to deliver and will not be able to enter into a contract with the User.

Once Paws&Pours receives the User’s purchase order through the Website, a pre-authorization will be placed on the applicable card to ensure there are sufficient funds to complete the transaction. The card will be charged at the time the User is sent the shipping confirmation and/or confirmation of the service provided in the manner and, where applicable, at the location specified.

In any case, by clicking “Buy,” the User confirms that the payment method used belongs to them.

Orders in which the User selects bank transfer as the payment method will be held for 5 calendar days from the date of order confirmation to allow sufficient time for the bank transfer to be processed by the payment system used by Paws&Pours for the Website. Once the system receives the transfer, the order will be prepared and processed for shipment.

When using this payment method, the User must ensure that they enter the exact amount of the purchase order, as well as the account number and the transfer reference. In the event of an error, Paws&Pours will be unable to process the order, which will be canceled.

6. DELIVERY

In cases where physical delivery of the contracted goods is required, deliveries will be made within the following territory: Spain (Mainland and Balearic Islands)

Except in cases of unforeseen or extraordinary circumstances, or, where applicable, circumstances arising from the customization of products, the purchase order consisting of the products listed in each purchase confirmation will be delivered within the timeframe indicated on the Website, in accordance with the shipping method selected by the User, and, in any event, within a maximum of 30 calendar days from the date of order confirmation.

If, for any reason attributable to Paws&Pours, we are unable to meet the delivery date, we will contact the User to inform them of this situation. The User may then choose to proceed with the purchase by setting a new delivery date or cancel the order and receive a full refund of the amount paid. In any case, home deliveries are made on business days.

If it is not possible to deliver the order because the User is not home, the order may be returned to the warehouse. However, the carrier will leave a notice explaining where the order is located and how to arrange for redelivery.

If the User will not be at the delivery location during the agreed-upon time slot, they should contact Paws&Pours to arrange for delivery on another day.

If 30 days have passed since your order became available for delivery and it has not been delivered for reasons not attributable to Paws&Pours, Paws&Pours will assume that the User wishes to withdraw from the contract, and the contract will be deemed terminated. As a result of the termination of the contract, all payments received from the User will be refunded, with the exception of any additional costs resulting from the User’s own choice of a delivery method other than the least expensive standard delivery method offered by the Website, without undue delay and, in any case, within a maximum of 14 calendar days from the date on which the contract is deemed terminated.

However, the User should be aware that shipping costs resulting from the return may incur an additional charge that may be passed on to the User.

For the purposes of these Terms and Conditions, delivery shall be deemed to have taken place, or the order to have been delivered, at the moment the User or a third party designated by the User takes physical possession of the products, as evidenced by the signature confirming receipt of the order at the agreed delivery address.

Any risks associated with the products shall be borne by the User upon delivery. The User acquires ownership of the products when Paws&Pours receives full payment of all amounts due in connection with the purchase or acquisition made, including shipping costs, or at the time of delivery, if delivery occurs after Paws&Pours has received full payment of the amount due.

In accordance with the provisions of Law 37/1992 of December 28 on Value-Added Tax (VAT), purchase orders for delivery and/or provision of services shall be deemed to be located within the territory subject to Spanish VAT if the delivery address is in Spanish territory, excluding the Canary Islands, Ceuta, and Melilla. The applicable VAT rate will be the one legally in force at any given time, depending on the specific item in question.

7. TECHNICAL MEANS FOR CORRECTING ERRORS

Users are hereby informed that if they discover an error in the information entered to process their purchase request on the Website, they may correct it by contacting Paws&Pours through the contact forms provided on the Website, and, where applicable, through those provided for contacting customer service, and/or by using the contact information provided in Section 1 (General Information). Furthermore, this information may also be corrected by the User through their personal account on the Website.

In any case, before clicking “Buy,” the User has access to the shopping area, cart, or basket where their purchase requests are listed and can make changes.

Similarly, Users are encouraged to review the Legal Notice and General Terms of Use, and specifically the Privacy Policy, to obtain further information on how to exercise their right to rectification as provided for in Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) and in Organic Law 3/2018 of December 5 on the Protection of Personal Data and the Guarantee of Digital Rights.

8. RETURNS

In cases where the User purchases products on or through the Owner’s Website, the User is entitled to a number of rights, as listed and described below:

Right of Withdrawal

As a consumer and user, the User makes a purchase on the Website and is therefore entitled to cancel that purchase within 14 calendar days without having to provide a reason.

This withdrawal period will expire 14 calendar days from the day on which the User or a third party authorized by the User, other than the carrier, took physical possession of the goods purchased on the Paws&Pours Website; or, if the goods comprising the order are delivered separately, 14 calendar days from the day the User or a third party authorized by the User, other than the carrier, took physical possession of the last of those goods comprising the same purchase order, or in the case of a service contract, 14 calendar days from the date the contract was entered into.

To exercise this right of withdrawal, the User must notify Paws&Pours of their decision. They may do so, if applicable, through the contact forms provided on the Website.

Regardless of the method chosen to communicate their decision, the User must clearly and unambiguously state their intention to withdraw from the purchase agreement. In any case, the User may use the model withdrawal form provided by Paws&Pours as an attachment to these Terms and Conditions; however, its use is not mandatory.

To meet the withdrawal deadline, it is sufficient to send a notice that clearly states your decision to withdraw before the deadline expires.

In the event of withdrawal, Paws&Pours will refund the User all payments received, including shipping costs (with the exception of any additional costs incurred by the User for a shipping method other than the least expensive option offered on the Website) without undue delay and, in any case, no later than 14 calendar days from the date on which Paws&Pours is informed of the User’s decision to withdraw.

Paws&Pours will issue a refund to the User using the same payment method the User used for the initial purchase. This refund will not incur any additional costs for the User. The User acknowledges that they will be responsible for any direct costs associated with returning the goods (shipping, delivery), if any are incurred. In addition, the User will be liable for any reduction in the value of the products resulting from handling that goes beyond what is necessary to determine the nature, characteristics, and functioning of the goods.

The User acknowledges that there are exceptions to the right of withdrawal, as set forth in Article 103 of Royal Legislative Decree 1/2007 of November 16, which approves the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws. By way of example, and without limitation, this would apply to: personalized products; products that are liable to deteriorate or expire rapidly; music or video CDs/DVDs without their original factory-sealed packaging; products that are sealed for hygiene or health reasons and have been unsealed after delivery; and the supply of digital content without a physical medium.

The provision of any service that the User may contract on this Website is governed by the same principle, as this same Law establishes that Users shall not have the right of withdrawal when the service has been fully performed, or when it has begun, with the express consent of the consumer and user and with their acknowledgment that they are aware that, once the contract has been fully performed by Paws&Pours, they will have lost their right of withdrawal.

In any case, no refund will be issued if the product has been used beyond simply opening it, if the product is not in the same condition as when it was delivered, or if it has been damaged after delivery.

In addition, products must be returned in their original packaging, along with any instructions and other accompanying documents, as well as a copy of the purchase receipt.

Return of defective products or shipping errors

This refers to all cases in which the User believes that, at the time of delivery, the product does not comply with the terms of the contract or purchase order, and who, therefore, must contact Paws&Pours immediately to report the non-conformity (defect/error) using the same methods or the contact information provided in the previous section (Right of Withdrawal).

The User will then be informed of the procedure for returning the products, and once returned, the products will be inspected, and the User will be notified within a reasonable time as to whether a refund or, if applicable, a replacement will be provided.

We will issue a refund or replace the product as soon as possible, and in any case, within 14 days of the date we send you an email confirming that a refund or replacement for the non-compliant item is warranted.

The amount paid for products returned due to a defect, provided such a defect actually exists, will be refunded in full, including shipping costs and any expenses the User may have incurred in returning the item. The refund will be issued via the same payment method the User used to pay for the purchase.

In any case, the User, as a consumer and user, shall always be entitled to the rights recognized under the laws in effect at any given time.

Warranties

As a consumer and user, you are entitled to warranties on the products you purchase through this Website, in accordance with the legal provisions applicable to each type of product. Paws&Pours is therefore liable for any lack of conformity that becomes apparent within three years of the product’s delivery.

In this regard, the products are deemed to be in compliance with the contract provided that: they conform to the description provided by Paws&Pours and possess the qualities set forth therein; they are suitable for the uses for which products of the same type are ordinarily intended; and they possess the quality and performance characteristics typical of a product of the same type and that are fundamentally expected of it. If this is not the case with respect to the products delivered to the User, the User must proceed as indicated in the section “Return of Defective Products or Shipping Errors.” However, some of the products sold on the Website may have non-uniform characteristics provided that these result from the type of material used in their manufacture, and which therefore form part of the product’s individual appearance and do not constitute a defect.

On the other hand, there may be cases where the User purchases a product on the Website that is branded or manufactured by a third party. In this case, if the User believes the product is defective, they may also contact the brand or manufacturer responsible for the product to find out how to exercise their legal warranty rights directly against them within three years of the delivery of said products. To do so, the User must have retained all information regarding the product warranty.

9. DISCLAIMER

Unless otherwise provided by law, Paws&Pours shall not be liable for the following losses, regardless of their cause:

any losses that were not attributable to any breach on your part;

business losses (including loss of profits, revenue, contracts, anticipated savings, data, goodwill, or unnecessary expenses incurred); or

any other indirect loss that was not reasonably foreseeable by either party at the time the contract for the sale of the products was entered into between the parties.

Similarly, Paws&Pours also limits its liability in the following cases:

Paws&Pours takes every measure to ensure that products are displayed accurately on the Website; however, it is not responsible for any minor differences or inaccuracies that may arise due to low screen resolution, issues with the browser being used, or other similar factors.

Paws&Pours will exercise due diligence in arranging for the delivery of the product covered by the purchase order. However, it shall not be liable for any damages resulting from transportation issues, particularly those caused by strikes, roadblocks, or other industry-specific factors that result in delays, loss, or theft of the product.

Technical failures, whether due to unforeseeable circumstances or other causes, that prevent the normal operation of the service via the internet. Unavailability of the Website due to maintenance or other reasons that prevent access to the service. In general, Paws&Pours shall not be liable for any failure or delay in fulfilling any of its obligations when such failure or delay is due to events beyond its reasonable control, that is, due to force majeure, which may include, but is not limited to:

Strikes, lockouts, or other industrial action.

Civil unrest, riots, invasion, terrorist threats or attacks, war (whether declared or not), or threats of war or preparations for war.

Fire, explosion, storm, flood, earthquake, landslide, epidemic, or any other natural disaster.

Inability to use trains, ships, airplanes, motor vehicles, or other means of transportation, whether public or private.

Inability to use public or private telecommunications systems.

Acts, decrees, laws, regulations, or restrictions issued by any government or public authority.

Consequently, the obligations will be suspended for as long as the force majeure event continues, and Paws&Pours will be granted an extension of the deadline for fulfilling them for a period equal to the duration of the force majeure event. Paws&Pours will use all reasonable means to find a solution that allows it to fulfill its obligations despite the force majeure event.

10. WRITTEN COMMUNICATIONS AND NOTIFICATIONS

By using this Website, the User agrees that most communications with Paws&Pours will be electronic (via email or notices posted on the Website).

For contractual purposes, the User agrees to use this electronic means of communication and acknowledges that all contracts, notices, information, and other communications sent electronically by Paws&Pours satisfy the legal requirement of being in writing. This provision shall not affect the User’s statutory rights.

11. DISCLAIMER

No waiver by Paws&Pours of any specific right or legal remedy, nor any failure by Paws&Pours to require the User to strictly comply with any of its obligations, shall constitute a waiver of any other rights or remedies arising from a contract or these Terms, nor shall it relieve the User of the obligation to comply with its obligations.

No waiver by Paws&Pours of any of these Terms or of any rights or remedies arising from a contract shall be effective unless it is expressly stated to be a waiver and is formalized and communicated to the User in writing.

12. NULLITY

If any of these Terms and Conditions are declared null and void by a final decision issued by a competent authority, the remaining provisions shall remain in full force and effect and shall not be affected by such declaration of nullity.

13. ENTIRE AGREEMENT

These Terms and Conditions and any document expressly referred to herein constitute the entire agreement between the User and Paws&Pours regarding the subject matter of the sale and supersede any prior agreement, understanding, or promise, whether oral or written, between the same parties.

The User and Paws&Pours acknowledge that they have entered into this agreement without relying on any statement or promise made by the other party, except as expressly set forth in these Terms and Conditions.

14. DATA PROTECTION

Any personal information or data that the User provides to Paws&Pours during a transaction on the Website will be processed in accordance with the provisions of the Privacy Policy or Data Protection Policy (included, where applicable, in the Legal Notice and General Terms of Use). 15. GOVERNING LAW AND JURISDICTION

At Paws&Pours, we strive to ensure that your shopping experience is safe and satisfying. If you are not satisfied with your order, you may request a return in accordance with current Spanish law.

This policy is based on Royal Legislative Decree 1/2007, which approves the consolidated text of the General Law for the Protection of Consumers and Users, and on the provisions relating to e-commerce.

1. Right of withdrawal (14 days)

Under Spanish law, customers have 14 calendar days from the date of receipt of the order to exercise their right of withdrawal, without having to provide a reason for their decision.

To exercise this right, the product must meet the conditions specified in the following section.

2. Return Policy

Returned items must:

  • Must be in perfect condition, unused, and unwashed.
  • Keep all original labels, packaging, and accessories.
  • Must be free of stains, odors, damage, or signs of use.

Exceptions under the regulations (returns are not accepted):

3. Procedure for requesting a refund

  • Follow the instructions provided by the customer service team.

4. Return shipping costs

The customer is responsible for the direct costs of the return, as permitted by law, unless the product is defective or was shipped in error.

In the event of an error or defect, Paws&Pours will cover the costs and send a return label or return instructions at no charge.

5. Refunds

Once the merchandise has been received and its condition verified:

  • We will process the refund using the same payment method you used.
  • The refund will be issued within 14 calendar days, as required by law.
  • In accordance with the regulations, we may withhold the refund until we receive the goods or proof that they have been returned.
  • The initial shipping costs for the order are non-refundable, except for returns due to defects or errors.

6. Changes

Exchanges for a different size, color, or product are handled as follows:

  • Return + new order, or
  • Direct exchange, if the store offers it and the item is in stock.

7. Defective products or errors in the order
